Terms of Service
KwetuLink • Effective Date: 1 June 2025
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and KwetuLink ("we", "us", or "our") governing your access to and use of our platform and related services.
By creating an account or using the Platform, you confirm that you are at least 18 years old, have the legal capacity to enter into binding contracts, and agree to these Terms in full.
Businesses and independent professionals registering on the Platform additionally warrant that they are duly registered under applicable laws and possess valid tax identification credentials (e.g., KRA PIN).
2. Description of the Platform
KwetuLink operates an online platform enabling Clients to discover, engage, and transact with Businesses and professionals offering specialized services, consultations, properties, and project fulfilment across Kenya.
KwetuLink acts as a facilitator and platform provider. We are not a direct party to service contracts formed between Clients and Businesses, and do not directly supply the underlying vendor services or property titles ourselves.
3. Account Registration
You must provide accurate, current, and complete information during account setup. Business accounts must utilize their official registered name and corresponding tax identification.
You are solely responsible for maintaining credential confidentiality and for all activities conducted under your account. Notify us immediately of any unauthorized access or breach.
We reserve the right to suspend or deactivate accounts that supply false information, misrepresent credentials, or violate these Terms.
4. Client Obligations
Clients agree to provide clear, complete project briefs, service requests, or listing inquiries.
Clients must remit agreed milestone payments promptly. Funds may be held securely in transaction escrow until verified delivery is acknowledged.
Clients shall not attempt to bypass platform service fees by arranging off-platform direct transactions with providers discovered through KwetuLink for a period of 24 months following initial contact.
5. Business Obligations
Businesses and service providers must possess all statutory licences, professional certifications, permits, and coverage mandated by Kenyan law for their listed offerings.
Providers must execute accepted work to a professional standard consistent with their profile representations, quotations, and agreed project scopes.
Businesses are responsible for reporting platform earnings and remitting required taxes to the Kenya Revenue Authority (KRA). KwetuLink may issue withholding tax documentation where legally mandated.
Businesses must not offer misleading, fraudulent, or non-compliant service listings or property opportunities.
6. Fees and Payments
KwetuLink applies a platform service fee on confirmed engagements. Applicable rates are clearly itemized prior to transaction authorization.
Payments are securely processed via integrated mobile money (M-Pesa) and card payment gateways. Full card numbers are never stored on our servers.
Payouts to providers are processed within 3 to 5 business days following satisfactory completion verification.
Refund requests are handled in accordance with our platform Dispute and Refund Policy.
7. Prohibited Conduct
You must not utilize the Platform to facilitate fraudulent activities, financial crimes, or unlawful acts under Kenyan or international law.
You must not harass, abuse, or discriminate against other users, partners, or platform personnel.
You must not reverse-engineer, scrape, or compromise platform infrastructure or data integrity.
Manipulating reviews, fabricating ratings, or operating duplicate deception accounts is strictly prohibited.
Violations may trigger immediate account termination, funds freeze pending investigation, and legal escalation.
8. Intellectual Property
All rights, titles, and interests in the Platform—including brand assets, interface design, code, and proprietary workflows—remain the exclusive property of KwetuLink.
By posting content (listings, portfolios, descriptions) on the Platform, you grant KwetuLink a non-exclusive, worldwide, royalty-free licence to host, display, and promote such media in connection with platform operations.
9. Limitation of Liability
KwetuLink provides the Platform on an "as is" and "as available" basis without warranties of uninterrupted availability or absolute error-free operation.
To the maximum extent permitted under law, KwetuLink shall not be liable for indirect, incidental, or consequential losses arising from platform usage or peer-to-peer agreements between users.
Our aggregate liability for direct claims shall not exceed the total platform fees paid by you to KwetuLink during the 3 months preceding the claim, or KES 10,000, whichever is greater.
10. Dispute Resolution
Disputes between Clients and Businesses should first be submitted to our internal platform mediation team for informal resolution.
Legal claims involving KwetuLink shall be governed by the laws of the Republic of Kenya, subject to the exclusive jurisdiction of competent courts in Nairobi County.
11. Termination
You may close your account at any time provided all open transactions and financial obligations have been fully settled.
KwetuLink reserves the right to suspend or terminate accounts upon 7 days' advance notice, or immediately in instances of serious security or policy violations.
12. Changes to Terms
We may update these Terms periodically. Notice of material modifications will be delivered via email or system notification at least 14 days prior to implementation. Continued use indicates acceptance.
