Privacy Policy

KwetuLink • Effective Date: 1 June 2025

1. Introduction

KwetuLink ("we", "our", or "us") operates our service platform — connecting clients, businesses, and professionals for project consultations, professional services, and listings in Kenya.

This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our website, mobile application, or any related services (collectively, the "Platform").

By accessing or using the Platform, you consent to the practices described in this Policy. If you do not agree, please discontinue use immediately.

2. Information We Collect

Account information: name (first and last for individual clients; registered entity name for businesses), email address, phone number, and encrypted credentials.

Business verification data: for professional and business accounts, we collect registered business numbers, tax identification details (e.g., KRA PIN), and statutory documentation to verify legal standing and enable compliant transactions under Kenyan laws.

Profile information: profile photo, contact details, location (county/region), service offerings, listing details, and professional background.

Transaction data: details of services requested or provided, payment milestones, invoices, and payout records managed through secure payment integrations.

Usage data: system telemetry, pages viewed, search requests, session duration, device indicators, IP address, and browser characteristics.

Communications: messages exchanged between users via our in-platform communication tools, customer support requests, and survey responses.

Cookies and tracking technologies: refer to Section 7 for details.

3. How We Use Your Information

To establish, maintain, and secure your account and verify your identity.

To facilitate seamless interactions between clients and service providers, including matching, messaging, and transaction management.

To satisfy statutory KYC/AML guidelines and business compliance requirements in Kenya.

To deliver essential service emails (account verification, security alerts, transactional receipts, and operational updates).

To distribute opt-in promotional communications; you can unsubscribe at any time.

To continuously optimize platform reliability, feature set, and user experience.

To identify, prevent, and mitigate fraudulent behavior, security vulnerabilities, and policy breaches.

To fulfill lawful regulatory obligations and enforce our legal terms.

4. Sharing Your Information

With other users: your public profile, verification badges, ratings, and active listings are visible to registered users. Basic contact details are shared between matched parties upon engagement confirmation.

With trusted service providers: we partner with reliable infrastructure providers — cloud hosting, payment gateways, transactional email services, and diagnostic tools. All providers are contractually required to maintain data confidentiality.

For legal & regulatory compliance: we may disclose details to administrative, tax (e.g., KRA), or law enforcement authorities when legally mandated or to defend safety and legal rights.

Business transfers: during corporate restructuring, mergers, or asset transfers, user records may be transferred with advance notice provided to affected parties.

We strictly do not sell your personal data to third parties for marketing purposes.

5. Data Retention

Account information is stored for the active duration of your account and retained for up to 7 years following account closure to meet tax and regulatory recordkeeping mandates in Kenya.

Financial and transactional logs are retained for a minimum of 7 years pursuant to applicable tax procedures.

Customer care records and support communications are archived for up to 3 years.

You may submit a request for the removal of non-mandatory personal data by emailing our privacy team.

6. Your Rights

Access: request a readable export of the personal information we hold about you.

Correction: update incomplete or outdated details directly in account settings or through support.

Deletion: request the removal of personal data that is not legally subject to mandatory retention.

Objection: opt out of processing your information for direct marketing purposes.

Portability: request your structured profile data in a machine-readable format.

To exercise your data privacy rights, email hello@kwetu-link.com. Requests are addressed within 30 days. Identity verification may be required prior to fulfilling requests.

7. Cookies

We utilize essential functional cookies (session management, security tokens), analytical cookies to gauge platform performance, and preference cookies to preserve your operational settings.

You can manage cookie preferences via your browser configuration. Disabling essential cookies may impact certain platform functions.

8. Security

We enforce robust safety measures including TLS transport encryption, AES-256 storage encryption, secure password hashing, and periodic vulnerability evaluations.

While we implement rigorous technical controls, no internet transmission is completely immune. Keep your login details confidential and notify us immediately of unauthorized account access.

9. Children

KwetuLink is strictly intended for individuals aged 18 and above. We do not intentionally collect data from minors. Accounts belonging to minors will be promptly removed upon discovery.

10. Changes to This Policy

We may revise this Policy periodically. Material updates will be communicated via email or prominent in-app notifications at least 14 days before taking effect. Continued platform usage indicates acceptance of updated terms.
